These Terms of Service (“Terms”) govern your access to and use of TEDDO, including the TEDDO mobile application, website, artificial intelligence features, and related services (collectively, the “Service”).

TEDDO is operated by Fortified Concepts (“TEDDO,” “we,” “us,” or “our”).

By creating an account, accessing TEDDO, or using the Service, you agree to these Terms. If you do not agree to these Terms, do not use TEDDO.

1. About TEDDO

TEDDO is an organizational and informational tool designed to help adults record, organize, review, and better understand health and care information for themselves, other people in their care, and pets.

TEDDO may allow users to:

• Record medications, symptoms, vital signs, meals, fluids, sleep, activities, appointments, procedures, and other health or care information

• Create medication reminders

• Upload documents and photos

• Review timelines, histories, charts, and trends

• Export reports

• Use artificial intelligence to log information, search stored information, summarize history, and identify possible patterns

TEDDO is not a healthcare provider and does not provide medical diagnosis or treatment.

2. Eligibility

You must be at least 18 years old to create a TEDDO account.

TEDDO is intended for adults, including parents, guardians, caregivers, and individuals managing their own health or care information.

TEDDO is not directed to children under 13, and children should not create TEDDO accounts.

An adult account holder may create and manage profiles containing information about a child, another adult in their care, or a pet.

By creating or managing a profile for another person, you represent that you have the authority or appropriate permission to enter and manage that information.

3. Your Account

You are responsible for:

• Maintaining the confidentiality of your account credentials

• Providing accurate account information

• Keeping your login credentials secure

• All activity occurring through your account

• Promptly notifying TEDDO if you believe your account has been accessed without authorization

You may not share your password or intentionally allow another person to access your account using your credentials.

TEDDO may suspend or restrict access to an account where we reasonably believe the account has been compromised, misused, or used in violation of these Terms.

4. Information You Enter

You are responsible for the accuracy, completeness, and appropriateness of information you enter into TEDDO.

TEDDO does not independently verify health, medication, symptom, dosage, appointment, or other information entered by users.

You should review important information before relying on it, particularly medication names, dosages, dates, times, and medical history.

You retain ownership of information, documents, photos, and other content you submit to TEDDO.

By submitting content to TEDDO, you grant us a limited license to store, process, reproduce, transmit, and display that content solely as necessary to provide, operate, secure, and improve the Service in accordance with our Privacy Policy.

5. Profiles for Other People

TEDDO allows adult users to create profiles for children and other adults in their care.

If you enter information about another person, you are responsible for ensuring that you have the legal authority, consent, or other appropriate basis to do so.

You agree not to enter health or personal information about another person where you do not have permission or authority to manage that information.

6. Artificial Intelligence Features

TEDDO includes artificial intelligence features powered by third-party technology, including Anthropic's Claude.

AI features may help users:

• Log information using natural language

• Ask questions about information stored in TEDDO

• Summarize health and care history

• Search previous entries

• Identify possible patterns or trends

• Organize information

• Perform AI-assisted web searches

AI-generated information may be inaccurate, incomplete, misleading, outdated, or misunderstood.

You are responsible for reviewing AI-generated responses before relying on them.

AI Is Not Medical Advice

TEDDO's AI features do not:

• Diagnose medical conditions

• Prescribe treatment

• Recommend starting, stopping, or changing medication

• Replace a physician, pharmacist, nurse, veterinarian, or other qualified professional

• Provide emergency medical services

AI-generated summaries, observations, trends, and answers are provided for organizational and informational purposes only.

Never delay seeking professional medical care because of information provided by TEDDO.

If you believe you or another person is experiencing a medical emergency, contact emergency services immediately.

7. Medication Information and Reminders

TEDDO may allow you to record medications, dosages, schedules, and reminders.

Medication reminders are convenience features only.

You are responsible for:

• Confirming medication names and dosages

• Following instructions provided by your healthcare professional or pharmacist

• Taking medications at the appropriate time

• Ensuring that reminders are configured correctly

• Ensuring your device is powered on and able to display notifications

TEDDO does not guarantee that a reminder will be delivered or displayed.

A reminder may fail to appear because of device settings, operating-system restrictions, battery status, notification permissions, user error, software issues, or other factors outside TEDDO's control.

Do not rely solely on TEDDO for time-sensitive or medically necessary medication administration.

8. Health and Medical Disclaimer

TEDDO is intended to assist with organization, recordkeeping, recall, and understanding of user-entered information.

TEDDO is not:

• A medical device unless specifically identified otherwise

• A healthcare provider

• A substitute for professional medical advice

• A diagnostic service

• A treatment service

• An emergency service

Any charts, timelines, summaries, trends, AI responses, reminders, or other information provided through TEDDO should be considered supplemental information only.

Always seek the advice of a qualified healthcare professional regarding medical conditions, symptoms, diagnoses, treatment, medication, or healthcare decisions.

9. Pet Information

TEDDO may be used to organize health and care information for pets.

TEDDO does not provide veterinary diagnosis or treatment and is not a substitute for a licensed veterinarian.

Contact a qualified veterinarian regarding questions about your pet's health, medication, diagnosis, or treatment.

10. User-Initiated Sharing and Exports

TEDDO may allow you to export information, including PDF reports, and share that information with healthcare professionals, caregivers, family members, or others.

You are responsible for deciding:

• What information to export

• Who receives it

• How it is transmitted

• Whether the recipient is authorized to receive it

Once information leaves TEDDO through a user-initiated export or share action, TEDDO cannot control how the recipient stores, uses, forwards, or protects that information.

11. Acceptable Use

You agree not to use TEDDO to:

• Violate any applicable law or regulation

• Infringe another person's privacy or intellectual-property rights

• Enter information about another person without appropriate authorization

• Attempt to gain unauthorized access to TEDDO, another user's account, or our systems

• Interfere with or disrupt the Service

• Introduce malware, harmful code, or automated attacks

• Scrape, crawl, or systematically extract data without written permission

• Reverse engineer or attempt to derive the source code of TEDDO except where applicable law expressly permits it

• Impersonate another person

• Use TEDDO for fraudulent or deceptive purposes

• Abuse AI functionality or attempt to bypass safety or security controls

We may suspend or terminate access for conduct that violates these Terms or threatens the security, integrity, or availability of TEDDO.

12. Subscriptions and Purchases

TEDDO may offer paid subscriptions or other paid features.

Purchases made through the TEDDO iOS application are processed by Apple through the App Store.

TEDDO does not receive or store your full payment-card details for App Store purchases.

Subscription Terms

If you purchase an auto-renewing subscription:

• The subscription will renew automatically unless canceled before the end of the current billing period

• Your Apple ID account will be charged according to the subscription terms shown at the time of purchase

• Pricing, duration, and included features will be displayed before purchase

• You may manage or cancel your subscription through your Apple account or App Store subscription settings

• Cancellation stops future renewal but generally does not provide a refund for the current billing period, except where required by law or Apple's policies

• Any free trial or introductory offer will convert to a paid subscription unless canceled before the trial or offer period ends

Apple controls billing, cancellations, refunds, and subscription-management functionality for App Store purchases.

TEDDO may change subscription pricing or features in the future, subject to applicable law and App Store requirements.

13. Availability and Changes to the Service

We may update, modify, add, or remove features from TEDDO from time to time.

We do not guarantee that every feature will always remain available.

We may temporarily suspend access to all or part of the Service for:

• Maintenance

• Software updates

• Security reasons

• Infrastructure failures

• Technical issues

• Events outside our reasonable control

We will make reasonable efforts to maintain reliable availability but do not guarantee uninterrupted or error-free operation.

14. Data Loss and Backups

We use reasonable measures designed to protect information stored through TEDDO.

However, no electronic system is completely reliable.

You are responsible for maintaining copies of information that you consider especially important.

TEDDO is not intended to serve as the sole legal, medical, or permanent archival record of your healthcare information.

15. Privacy

Your use of TEDDO is also governed by our Privacy Policy.

The Privacy Policy explains what information we collect, how it is processed, which service providers may receive information, and your choices regarding your data.

16. Account Deletion and Termination

You may request deletion of your account through the TEDDO application.

TEDDO currently provides a 30-day grace period after an account-deletion request, during which you may cancel the deletion request.

After the grace period, your account and associated active data are scheduled for permanent deletion in accordance with our Privacy Policy.

We may suspend, restrict, or terminate your access to TEDDO if:

• You violate these Terms

• Your use creates a security or legal risk

• You misuse the Service

• We are required to do so by law

• Continued operation of the account would materially harm TEDDO or other users

Where reasonably practical, we will attempt to provide notice before terminating an account unless immediate action is necessary for security, legal, or safety reasons.

17. Intellectual Property

TEDDO, including its:

• Name

• Logos

• Branding

• Software

• User interface

• Design

• Graphics

• Text

• Features

• Documentation

• Underlying technology

is owned by Fortified Concepts or its licensors and is protected by applicable intellectual-property laws.

These Terms do not transfer ownership of TEDDO or its intellectual property to you.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use TEDDO for its intended purposes.

18. Feedback

If you provide suggestions, ideas, comments, or other feedback about TEDDO, you agree that we may use that feedback without restriction or compensation to you.

You are not required to provide feedback.

19. Third-Party Services

TEDDO relies on third-party services and infrastructure, which may include:

• Supabase

• PowerSync

• Anthropic

• Resend

• Expo

• Apple

TEDDO is not responsible for interruptions, outages, errors, or other issues caused by third-party providers outside our reasonable control.

Your use of certain third-party services may also be subject to those providers' own terms and privacy policies.

20. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEDDO IS PROVIDED “AS IS” AND “AS AVAILABLE.”

FORTIFIED CONCEPTS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF:

• MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• NON-INFRINGEMENT

• ACCURACY

• RELIABILITY

• AVAILABILITY

WE DO NOT WARRANT THAT:

• TEDDO WILL ALWAYS BE AVAILABLE

• INFORMATION STORED OR DISPLAYED WILL ALWAYS BE ACCURATE OR COMPLETE

• AI RESPONSES WILL BE CORRECT

• REMINDERS WILL ALWAYS BE DELIVERED

• THE SERVICE WILL BE FREE FROM ERRORS OR INTERRUPTIONS

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTIFIED CONCEPTS AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF TEDDO.

THIS INCLUDES DAMAGES ARISING FROM:

• LOSS OF DATA

• MISSED REMINDERS

• RELIANCE ON INCORRECT USER-ENTERED INFORMATION

• RELIANCE ON AI-GENERATED INFORMATION

• HEALTHCARE DECISIONS

• THIRD-PARTY SERVICE FAILURES

• UNAUTHORIZED ACCOUNT ACCESS

TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF FORTIFIED CONCEPTS ARISING OUT OF OR RELATING TO TEDDO WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID TO TEDDO DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
(B) $100.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Fortified Concepts and its owners, employees, contractors, affiliates, and service providers from claims, damages, losses, liabilities, and expenses arising from:

• Your misuse of TEDDO

• Your violation of these Terms

• Your violation of another person's rights

• Information you enter without proper authorization

• Content you upload or share through TEDDO

23. Governing Law

These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law principles.

Any dispute arising from these Terms or TEDDO will be brought in the state or federal courts located in [COUNTY, STATE], unless applicable law requires otherwise.

24. Apple App Store Terms

If you access TEDDO through Apple's App Store, you acknowledge that:

• These Terms are between you and Fortified Concepts, not Apple

• Apple is not responsible for TEDDO or its content

• Fortified Concepts, not Apple, is responsible for providing maintenance and support for TEDDO

• Apple has no obligation to provide maintenance or support services

• Apple is not responsible for claims relating to TEDDO, including product-liability claims, regulatory claims, or consumer-protection claims

• Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the iOS application

• Your use of TEDDO must comply with Apple's applicable App Store rules and usage terms

Unless TEDDO provides a separate custom End User License Agreement, your use of the iOS application is also subject to Apple's Standard Licensed Application End User License Agreement.

25. Changes to These Terms

We may update these Terms from time to time as TEDDO changes or legal requirements evolve.

If we make material changes, we may notify you through the app, by email, or by updating the “Last Updated” date above.

Your continued use of TEDDO after updated Terms become effective constitutes acceptance of the revised Terms where permitted by law.

If you do not agree to revised Terms, you should discontinue use of TEDDO and may delete your account.

26. Entire Agreement

These Terms, together with the TEDDO Privacy Policy and any additional terms presented for specific features or purchases, constitute the agreement between you and Fortified Concepts regarding your use of TEDDO.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
